MCM SALONE GAME 2025
The sponsor of the MCM Gamification for Milano Design Week 2025 (“Game”) is: MCM Global AG with a business address at Baarerstrasse 137, 6300 Zug, Switzerland (“MCM”), and may be contacted via email at contact.eu@mcmworldwide.com. By participating in the Game, MCM customers (“Entrants”) agree to abide by the following terms and conditions:
1. Consideration for entering the prize draw of the Game
The Game includes a prize draw, which Entrants can enter subject to the conditions as further described in the Game instructions. In return for entering the prize draw of the Game, the Entrants grant and consent MCM the right to use the personal data that is provided in the Game for sending regular communication about MCM collections, news, and offers in accordance with the privacy policy.
2. Participation in the Game
a. The Game is available via the MCM online platform specifically created for the Game by MCM (the “Platform”). The Game will be run via the Platform from March 25th until April 25th 2025. Participation in the Game must take place within this period.
b. Participation is restricted to residents of the following countries, who are at least 18 years of age as of March 25th, 2025. Employees of MCM or a company affiliated with MCM, are excluded from participation.
c. To participate in the Game, Entrants shall be required to access the Game, and gain points through the Game as further described in the Game instructions.
d. MCM reserves the right to disqualify any Entrants that does not comply with these terms and conditions or is deemed inappropriate.
e. This Game is not sponsored, endorsed, or associated with other platforms or social media and, by participating in this Game, Entrants hereby release MCM of any and all claims and liabilities associated with the Game.
3. Processing of the prize draw
a. The Entrants , who obtain all the points as further described in the Game instructions and provide their personal data through the data capture in accordance with Section 4.b. will be entered into a prize draw and five winners will be selected at random from the prize draw.
b. The prize draw will take place on May 5th 2025. Each winner will receive one MCM product, valued at approximately CHF 132. Winners will be notified via email within 4 weeks following the prize draw and must contact MCM via email within 7 days of notification to claim their prize. Once MCM receives the winner's details, the prize will be delivered within 30 days. If no data are sent by the specified date, MCM will proceed with selecting the next winner and remove the previous customer details from the system. MCM shall furnish the prize(s) inclusive of any necessary shipping and delivery costs.
c. Prizes are non-transferable and cannot be exchanged for cash or other products. MCM reserves the right to modify or cancel the Game at any time without prior notice. MCM will make use of this option in particular in the event of technical or legal issues that may cause that the proper running of the Game cannot be guaranteed.
d. This Game is subject to all applicable laws and regulations.
4. Data Protection
a. MCM observes all relevant data protection regulations in the context of the Game.
b. Participation in the Game is voluntary but entering the prize draw requires Entrants to consent to MCM processing the personal data provided in the sign-up process for the purpose of administering the prize draw in accordance with the privacy policy.
The respective Entrant him/herself provides information of surname and first name, birthday, address, phone number and email address via the sign-up process on the Platform. The personal data are required are required and will be processed by MCM for the purposes of processing the prize draw. The legal basis is Art. 6 para. 1 lit. b GDPR. Entrants may also grant and consent to MCM the right to use the personal data provided in the sign-up process for sending regular communications about MCM collections, news, and offers in accordance with the privacy policy.c. Entrants can object to the further processing of personal data at any time by contacting MCM at contact.eu@mcmworldwide.com . If the Entrant objects before the prize draw, he/she will be excluded from it.
d. In order to comply with retention periods under tax and commercial law, MCM stores the personal data collected as part of the Game for a period of 10 years. The Entrant can request information about his/her personal data at any time and have it corrected and/or deleted and/or restrict the further processing of this data.
e. To exercise the aforementioned rights, the Entrant can contact MCM by letter or email to the contact details above. If the Entrant has any questions, comments or requests regarding the collection, processing and use of personal data by MCM, the Entrant can contact MCM at any time using the contact details above. If the Entrant is of the opinion that the processing of data violates data protection laws, the Entrant is entitled to lodge a complaint with a supervisory authority.
5. Liability (only applicable for EU Entrants )
a. MCM shall be released from all obligations arising from this Game after the prize has been sent to the Entrants, unless an earlier date is specified in these provisions.
b. MCM shall only be liable for damages caused by gross negligence or intent on the part of MCM, a legal representative or vicarious agent of MCM.
c. In addition, in the event of a slightly negligent breach of material contractual obligations, MCM shall be liable for foreseeable damage typical of the contract. Essential contractual obligations are those whose fulfilment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies on and may rely. Otherwise, the liability of MCM is excluded.
d. MCM’s liability resulting from injury to life, limb or health remains unaffected by the afore-mentioned limitations of liability. MCM’s liability under the German Product Liability Act and for a guarantee assumed by MCM shall also remain unaffected.
e. Furthermore, MCM shall not be liable if the contest cannot be held and/or the participant cannot claim the prize due to force majeure or other obstacles that MCM could not foresee and/or influence and that cannot be overcome by reasonable efforts, provided that MCM is not responsible for them.
6. Acceptance of Terms
a. By participating in the Game, Entrants acknowledge that they have read, understood, and agreed to abide by these terms and conditions.
b. Entrants further agree to comply with any additional instructions or rules provided by MCM during the course of the Game.
7. Miscellaneous
a. Legal action is excluded.
b. Should one of these provisions be or become invalid, this shall not affect the validity of the remaining provisions of these Terms and Conditions of Participation.
